Fighting Over Dogs and Cats

Nowadays, many of us pet parents, consider our fur babies our children. There is nothing wrong with that, in my humble opinion. Except that the law considers them property not kids. Still, issues like divorce bring up similar considerations between spouses, what to do about the fur kids. Who gets to “keep” the fur kids? Will custody be shared? Can one party “keep” the fur baby and how often can the other party visit? Below an attorney, guest blogger, Charla Bradshaw, flushes out the issues more fully.

The American Academy of Matrimonial Lawyers conducted a poll of 1,500 members and nearly a quarter said they had noticed an increase in custody issues over pets. Courts have had to determine not only who gets the pet but whether one party has the right to see the pet after the marriage breaks up.  Identifying the best interests of the pet in a divorce case can safeguard that the pet is properly cared for after divorce.

Pets can provide unbelievable companionship and unconditional love for adults and children.  Animals such as dogs, cats and horses are considered personal property for divorce purposes and unfortunately can also be the subject of domestic violence.

In a divorce, pets must be awarded as part of the property division and therefore will usually go to one spouse or the other.  However, spouses can choose to co-own the pet going forward and create a visitation schedule for the pet.  We have done these orders and they actually work very well.  We also see pet schedules associated with a child’s visitation schedule where the pet goes with the child.  When spouses co-own a pet, going forward, we must provide provisions for the expenses related to the animal. This can be important when dealing with livestock, such as horses, or an animal that has health issues.

Since pets are considered personal property, there can be disputes over whether the pet is the separate property of one of the spouses or community property.  Separate property can be acquired by a gift, inheritance, or if the property was owned on the date of marriage.  Separate property cannot be divided by a court.  Spouses may argue over whether the pet was a “gift”, or whether the spouses bought the pet together, making the pet community property subject to being awarded to one spouse or the other.

Unfortunately, pets are often targets in family violence but Texas has come to the rescue.  Texas courts can now include pets in protective orders in domestic violence cases. Because pets have suffered abuse when family violence has occurred, in 2011 the Texas legislature amended the law to prohibit the removal of animals from the possession of a person named in the protective order.  In a protective order, the court may prohibit a party from removing a pet, companion animal, or assistance animal, as defined by Section 121.002 of the Human Resources Code, from the possession or actual or constructive care of a person named in the protective order.  The “actual or constructive care” verbiage was added in 2013.  In turn, in 2013, the Texas Penal Code was amended to specify what the possession of a pet, companion animal, or assistance animal by a person actually means.

So what do these protective order laws actually mean for pets?  They mean that a person subject to a protective order that violates a pet provision in the protective order can go to jail, plain and simple.  An abuser will often turn on a pet to cause pain and suffering not only to the pet, but to the perpetrator’s victim(s).  An abuser may also threaten a pet’s life in order to keep their victim(s) close.  As a result, a victim may stay in an abusive situation to keep the companionship of the pet, not realizing the court can make orders with regard to the pet.

One of the problems is that most facilities and shelters for those running from family violence are not equipped to take animals and therefore the animals are left behind. There is a growing need in this regard not only for the safety of the pet but because the unconditional love a pet can give may be lost at the time it is needed the most.

Divorce or abuse can actually take a toll on a pet.  The Humane Society of the United States sets forth the following signs of pet stress:

•    They become depressed

•    They sleep a lot

•    Their appetite lessens

•    They’re not interested in their walks or other daily activities

•    They start to cry or whimper

•    They groom, lick and/or bite themselves excessively

•    They have accidents in the home

The bottom line is that pets are often the subject of divorce and family violence and the laws are improving to protect them.  It is important for everyone to be aware of these laws especially so that abuse victims may realize the court can include a pet in a protective order.  Abuse is bad enough for the lives of those who suffer it, but losing or leaving behind a pet can only make the suffering worse.

Victims asking a court for a protective order should ask the court to make orders regarding their pet(s).  Additionally, spouses in a divorce should be aware that pet(s) are property.  Sadly, a pet may become the subject of a very expensive fight when the real issue is to cause pain to the other spouse.

Mothers day is Sunday May 12… next weekend !!!

What’s cooking for Mothers Day?  Why not take your mom to dog friendly SLO for a week or the weekend?

San Luis Obispo County Has Tons of Dog Friendly Places to Explore

San Luis Obispo is located midway between San Francisco and Los Angeles, and a few hours south of Monterey county. It is known as the Happiest City in America… According to Dan Buettner’s National Geographic book Thrive, “San Luis Obispo has snagged the top spot for happiest people in America.”

Below are some suggestions of dog friendly places to stay and visit while you are in SLO.

Take a dog friendly wine tour in Paso Robles or San Luis Obispo regions with a Breakaway Tours Dog Day Wine Tour.

Mom and dog can learn how to surf at Pismo beach with miles of lovely sand and waves. Amble along the boardwalk, fish from the historic pier, or explore Pismo Beach Monarch Butterfly Grove, which hosts an average 25,000 butterflies per season.

Lunch at the Splash Cafe (try the yummy clam chowder) is a must.

Mom and pooch will feel right at home at a pet friendly oceanfront hotel such as the SeaCrest OceanFront. Take a walking tour of the downtown of the Happiest City, SLO, visit Bubble Gum Alley, the dogs will LOVE the creek that goes through downtown, and dogs are even welcome at the San Luis Obispo Museum of Art. Also, check out the pet boutique Tails for yummy treats for the canines. Other pet friendly attractions include the San Luis Obispo Botanical Gardens.

Enjoy a leisurely dinner at a pet friendly restaurant such as Luna Red. Their patio is filled with guests and their four legged friends. And the food and wine is to drool for. Organic, sustainable fresh seafood and salads.   Crab lasagne, wild boar spare ribs and a variety of vegetarian fare.

After dinner, head on down to Grover Beach, and relax at a beach party with bonfires, wine and s’mores and all.  Beach Butlerz will set up bonfire pits, each with a good supply of seasoned firewood, luxe beach chairs, a Luxe Cabana (ultra style), tiki torches, and a 12–‐foot tall teepee decked out with plush pillows and all the fixings to create s’mores. Pooches all aboard on a Tiki Boat tour of the Morro Bay Harbor on the Lost Isles Cruise.  View the wildlife in their natural habitat, and sea otters, seals, sea lions, and a wide variety of birds in Morro Bay’s beautiful estuary. The dogs will love the sounds of the sea life.


Lots of shopping and meandering after the cruise along the Embarcadero… Then enjoy a great meal of freshly caught fish, smoked oysters, calamari, fish and chips and more. at Tognazzini’s Dockside Restaurant. Tognazzini’s is also home to three beautiful and friendly white Labs.

Before you leave the coast, be sure to take a coastal hike at one of the many pet friendly parks such as Montana De Oro (Mountain of Gold).

After lunch, you may want to relax or head up the coast to San Simeon. Tour the infamous Hearst Castle (or save that for the next day).

Dogs are NOT allowed at the castle.  If you want to visit and do not want to leave the dogs alone, hire a pet sitter from Faithful Friend Pet Sitting Service.

You can also enjoy wildlife viewing including bird-watching, whale-watching, sea otter preserves, and elephant seal viewing and the dogs can roam along the beach.

Stay at the pet friendly Best Western Cavalier Oceanfront Resort, Cambria and San Simeon’s only oceanfront accommodation that offers direct beach access to dog friendly beaches and 14 acres for walking the dogs. A King room with oceanview has a fireplace and your very own patio. There is a hot tub/jacuzzi and pool on property and bonfires at sunset.


Check out the artistic town of Cambria. Be sure to enjoy lunch or dinner at Robin’s Restaurant. The gorgeous garden patio will be a treat for the dogs and your mom alike. The food will please everybody. Unique starters such as Singapore chicken sate, fresh inviting straight from the garden salads and curried chicken and other sandwiches are what’s for lunch. For dinner, lamb curry, Tail Lobster Enchiladas, Malaysian chicken and Moroccan duck breast entrees, plus delectable desserts (hot fudge sundaes with coffee ice cream and pistachio nuts) , Robin’s seasonal menus are prepared from scratch.

Top off the weekend with a visit to one of Paso Robles pet friendly wineries. Ecluse features Bordeaux and Rhone style wines, as well as their fabulous Zinfandel. Meet and greet Ecluse Winery’s blind dog Toby.

Ecluse has a special love for dogs and produces “Blind Dog Wines” In honor of their assist dogs that both lost their vision, they have created an eclectic blend of some of the best Paso Robles reds. Last minute poochie mama day gifts

So you waited too long again. Mother’s Day is Sunday and you failed to get Mom’s card in the mail, and your options are running out fast. Instead of beating yourself up and sending Mom an “I owe you,” look at this as an opportunity to get a bit creative…and more personal.

Spend the day at the zoo, a farm, visiting a shelter, hiking or going to the beach with the dog along or other fun activity you can do together. Be creative.

Visit a dog friendly winery and take a wine tour together.

Knit/crochet a blanket for the mama and pet to share or donate one to your local pet shelter (in honor of your mother, grandmother, aunt or loved one).

Americans love dogs

Americans love dogs but do we love women?  just throwing that out since it seems like some people who call themselves American are waging war on women. They also don’t seem to care that much about dogs, animals, the environment, other people either.

in life, we have choices to make every day…  and sometimes they are easy and other times they are difficult…

and it is not always as simple as this…

President Obama echoed his support for the Supreme Court’s pro-choice decision in Roe v. Wade.

“Government should not intrude on private family matters,” Obama said in a statement, adding that he also supports policies to prevent “unintended pregnancies.”

Romney was weak about Rush Limbaugh, “It’s not the language I would have used,” Romney said of Limbaugh’s comments  while President Obama called Sandra Fluke personally.

Obama said at a news conference that he’d called Fluke after Limbaugh made his comments “because I thought about Malia and Sasha, and one of the things I want them to do as they get older is to engage in issues they care about, even ones I may not agree with them on. I want them to be able to speak their mind in a civil and thoughtful way, and I don’t want them attacked or called horrible names because they’re good citizens.”

Obama on women’s health care

Romney’s support for personhood amendments and the Blunt Amendment is evidence that he’s going as far to the right as anyone can when it comes to women’s reproductive health.

Romney wants to tax the middle class and poor while President Obama wants to tax the 1%…

Romney’s pitch is that he’s Mr. Fix It — a corporate turnaround artist with an MBA. Looking for a candidate who’ll get the economy moving and put people back to work? Just so long as you overlook his only leadership experience in government and all the mass layoffs he orchestrated at his vulture-capital firm, Romney’s your guy.

What happens to that pitch if the economy improves, growth strengthens, and job creation picks up steam before the election? I don’t know. More importantly, I don’t think Romney knows, either.

Santorum’s pitch is altogether different. Whether the unemployment rate is 8.3% or 3.8%, Santorum is offering a message about culture, values, and religion. He doesn’t like contraception; he wants to restrict access to pornography; and a spirited defense of the separation of church and state makes him, in Santorum’s words, want to “vomit.”

As the former senator put it yesterday, “My campaign doesn’t hinge on unemployment rates and growth rates. It’s something more foundational that’s going on.”

Whether one finds Santorum’s agenda offensive or not, at least this is coherent and consistent. Unlike so many Republicans, he’s not rooting for bad economic news before the election, because the health of the economy is independent of his right-wing societal vision.

What good is a law that adds only pain and difficulty to perhaps the most painful and difficult decision a woman can make? Shouldn’t women have a right to protect themselves from strangers’ opinions on their most personal matters? Shouldn’t we have the right not to know?

There are bills like these being considered and/or passed in states that have GOP governors and/or where the GOP has the majority.

GOP legislators have sought to exempt religious orgs from having to offer health insurance that covers contraceptives.

…In Arizona and Kansas, Republican state legislators pushed bills allowing a doctor to lie about the health status of your fetus for fear you might opt to get an abortion.

And should you make that harrowing choice, Virginia Republicans, following in the footsteps of their colleagues in a number of other states, passed a law requiring that you have an ultrasound first.
